Current Judicial Practice In Family Law Matters
On April 21, 2023, I participated in an online seminar led by JUDr. Renáta Šínová, Ph.D. and Mgr. Veronika Bočanová on the topic of current judicial practice, among other things, in the area of alternating custody and child participation rights.
The discussion included the topic of integrating children into the parents' new families, i.e. the involvement of the parents' new partners in care.
The feeling of one parent that the new partner of the other parent should not be involved in the care of their child is quite common. However, it is necessary to distinguish whether the situation has a real negative impact on the child.
I believe that I will be in agreement with the majority of my colleagues in the opinion that it is possible to consider any bans on the child's contact with the parent's new partner only in clear, virtually extreme cases.
I will add that the Czech Civil Code assumes that not only the (new) spouse or registered partner of the parent, but also any person who lives with the child and its parent in the family household, will in fact participate in the care of the child.
